While power circles are busy guessing whether president Zardari would reappoint SC Judge Khalilur Rehman Ramday as an ad hoc-judge upon his retirement later this month, as recommended by the chief justice as well, the former Chief Justice of Pakistan, Justice Saeeduzzaman Siddiqi, has opined that the president could reject the CJ’s recommendation but he (president) would be required to give reasons for doing so.
Talking to The News from Karachi, former CJ Siddiqi also made it clear that President Zardari would be required to first appoint a permanent judge of the SC against a vacancy falling vacant because of the retirement of Justice Ramday on January 12, before even considering his name for his appointment as ad hoc judge in the light of recommendation of CJ Iftikhar Mohammad Chaudhary.
Mincing no words, Siddiqi said that if the chief justice of a provincial high court was recommended for elevation as an SC judge to fill the vacancy, falling vacant after retirement of Justice Ramday, and he refused to come to Islamabad, then he would stand retired.
He said so when asked what would happen in case the LHC CJ Khawaja Sharif, who was being tipped to replace Justice Ramday, refused to join the SC and instead some junior judge of the court was recommended for elevation.
Siddiqi explained that first we would also be required to see that who was recommended for the elevation to the post of an SC judge after the retirement of Justice Ramday by CJ Iftikhar Muhammad Chaudhry. He said if the CJ recommended the name of the LHC CJ, then he would be required to join the bench at Islamabad; otherwise, he would stand retired.
The former CJ Siddiqi said traditionally the president of Pakistan followed the recommendation of the CJ to make an appointment of a particular judge whether permanent or ad hoc.
But, he said, there was no specific law governing the issue as far as refusal of the president was concerned.
But, he believed that the president could reject the name of a particular judge and send it back to the CJ for withdrawing his name. But, Siddiqi said for this purpose President Zardari would be required to give valid reasons behind his decision why he was not interested in appointing a particular judge on ad hoc basis.
He said the CJP could again send the same name of the judge with his own reasons back to the Presidency for appointment.
Former CJ Siddiqi is widely respected in the political and judicial circles of Pakistan after he refused to take oath under the PCO when General Pervez Musharraf had asked the judges of the SC to take an oath of allegiance to him. He was one of the few honourable judges who had preferred to go home instead of taking the oath to facilitate the military rule of a dictator.
Earlier, Siddiqi said, the issue of appointment of judges to the SC was permanently settled in the Aljihad Trust case judgment of March 24, 1996, when the SC bench led by CJ Sajjad Ali Shah had laid down the principles of appointment of the judges to superior courts.
He said we needed to understand why the ad hoc appointments of the judges were discouraged through this judgment as the governments of the day used to appoint the ad hoc judges to put them under pressure and subsequently use them for their own vested interests.
The former CJ even recalled a case of ad hoc judges when permanent judges were pitched against the ad hoc judges, and it had created big deadlock in the working of the Supreme Court.
The former chief justice said that the Aljihad case had settled many important issues as far as appointment of judges in the higher judiciary was concerned.
He said according to this judgment, no ad hoc judge could be appointed against a permanent seat of the SC.
But he said after the completion of strength of the SC, if the CJ felt that because of mounting pressure and load of work on the court, he needed some extra judges to help the court, then he could send recommendation to the president of Pakistan. But Siddiqi hastened to add that ad hoc judge was never considered as a permanent part of 17 members SC bench.
He said one ad hoc judge was already working in the Supreme Court of Pakistan and so the CJ could also recommend another judge for ad hoc posting.
The former CJ said for this purpose, the CJ should first fill the permanent post of the judge and then ad hoc appointment should be considered.
He said the CJ could use the pressure of work as a valid reason to get a judge appointed as ad hoc judge for a particular period.

English, by no means, is a measure of ones intelligence or loyalty to the country, but unfortunately it is a measure of level of education. Education which expands ones horizon and give one an ability to analyze.
@Jago Karachites, are you saying that Pakistanis educated in madrassas are not educated? Education has nothing to do with a given language. It is obvious you need an education more than the people you have accused as being uneducated. It is another matter that madrassas in Pakistan deal more with terrorism and virgins than imparting any wisdom.
@MQM_Paindabad, I am merely pointing out a simple fact that most of the MQM supporters have bad english. Usually cursing their criticizers in Urdu with rhetoric
and without logic. This claim is not just based on reading websites, it is also complemented by being on the receiving end of Bhatta Khori and home robberies done by sector offices in their own communities.
None of great heroes of Islam knew english, but I consider them highly educated and most knowledgeable. But when it comes to today’s education, ability to express yourself in english does show level of education. And if you noticed, I did say it is an “unfortunate” measure.
You say lanuage has nothing to do with education? Wrong. Can you be a professional doctor or engineer without knowing english? (This may not applies to all countries, but does apply to pakistan).
Can you be an Islamic Scholar without knowing Arabic? So my friend, see my comments in proper context and you will see the light.

اے محب ِ وطن دانشورو ! خدا کے لیئے اس ملک پر رحم کرو ۔ اس ملک کو مزید نقصان نہ پہنچاؤ ۔ تم سے پہلے جنہوں نے اس ملک اور اس کے عوام کو نقصان پہنچایا وہ بھی اپنے آپ کو محب ِ وطن ہی سمجھتے تھے، وہ کب کہتے تھے کہ ہم اس ملک کے دشمن ہیں ؟ وہ بھی اپنے آپ کو دانشور سمجھتے تھے ۔ وہ کب کہتے تھے کہ ہم بے وقوف ہیں ؟
یقین جانیئے کہ جو لوگ یہ نعرے لگاتے ہیں کہ ہم غیر جمہوری طریقوں سے حکومت کو گرنے نہیں دیں گے یہ بھی اس لیئے کہتے ہیں کہ انہیں ابھی حکومت گرتی ہوئی نظر نہیں آتی ، جب یہ موقع آیا تو نہ صرف یہ کہ بچانے میں اپنا کردار ادا نہیں کریں گے بلکہ جس طریقے سے بھی حکومت کو ہٹایا گیا یہ اسی طریقے کے عین جمہوری ہونے کے حق میں ایسی ایسی دلیلیں گے کہ سچائی انگشت بدنداں رہ جائے گی ۔ !
فوج کے اشارے پر ایم کیو ایم اگر حکومت سے نکل کر اپوزیشن بینچوں پر بیٹھ جاتی ہے اور حکومت کی عددی اکثریت خطرے میں پڑ جاتی ہے تو کیا پی ایل ایم نواز حکومت کو گرنے سے پچانے کے لیئے اس کا حصہ بننے پر تیار ہو جائے گی ؟ نہیں اور کبھی نہیں ۔۔۔۔۔۔ !!
تو پھر نتیجہ کیا نکلا ؟
یہی کہ غیر جمہوری قوت نے عوام کی پانچ سال کے لیئے منتخب سول حکومت کو گرانے کے لیئے جو حکمت عملی ، پلان یا سازش تیار کی اس میں وہ کامیاب رہے اور جمہوریت کا راگ الاپنے والوں نے اسے بچانے کے لیئے کوئی کردار ادا نہ کیا

DR we always trust you whatever you say about the corrupt politicians i.e PPP and co, as whatever you predict about these people, time prove it later on. Bhaiyon, ye “proud to be Pakistani” ke naarey bas ek dho saal ke liye rahega. Uske baad “proud to be Jinnahpuri”, “proud to be Punjabi” aur “proud to be Balochi” ke naarey lagatey rahogey. Apne apne mulk pehle se hi chun lena. 2012 is the date that Pakistan will break up. Tab tak apne landar mulk ka khayal rakhna.
All of we are Pakistani, be little bit mature to get rid off self orientation…….
